EP Tech – Sales Terms & Conditions

1. Final Sale
All sales are final. No refunds, returns, or cancellations will be accepted under any circumstances.

2. Delivery & Handling Disclaimer
EP Tech is not responsible for any damage or malfunction caused by improper handling, unloading, or installation of the machine after it leaves our facility.

3. Payment Terms
All payment terms are as stated in the final invoice or contract. Full payment must be received prior to release or shipment unless otherwise agreed in writing.

4. Pricing and Taxes
Unless explicitly stated otherwise:

  • All prices are quoted Ex-Works (EXW) from the point of shipment.

  • Prices do not include any government-imposed sales tax, use tax, import or export duty, tariff, customs fee, or other levies.

  • All such fees are the sole responsibility of the Buyer, even if initially estimated or listed separately.

  • EP Tech reserves the right to adjust invoiced charges to reflect changes in such fees prior to shipment.

5. Duties & Customs Charges
If any customs duty, tariff, or import-related fee increases after the issuance of a quote or invoice, the Buyer agrees to cover the difference unless otherwise agreed in writing. EP Tech is not liable for changes in trade policy, tariffs, or customs classifications issued by government authorities.

6. Indemnification
The Buyer agrees to indemnify and hold harmless EP Tech from any and all claims, damages, or liabilities arising from accidents or improper use of the machines, including failure to install safety devices or follow manufacturer instructions, warnings, or applicable laws (including OSHA and other safety regulations).

7. Shipping & Freight
The Buyer is responsible for all freight costs and related shipping expenses including, but not limited to: rigging, crating, loading, brokerage, insurance, and customs clearance, unless otherwise stated in writing.

8. Limitation of Liability
EP Tech shall not be liable for any consequential or incidental damages, including but not limited to, personal injury or damage to other property. Our liability is strictly limited to the purchase price of the equipment sold.
